These terms and conditions ("Terms") form the basis on which you can visit and use our Website. Our Privacy Policy explains how we use your information that we collect. Please read both carefully as they contain important information.

This Website is owned and operated by Re-LCD Ltd trading as LCD Waste  ("we", "us" or the "Company"), of 270 Romford Road, Forest Gate London, E7 9HZ.

Definitions used in these Terms:

Profile

Means collectively the personal information, Payment Information and credentials used by Sellers to access the Services on the Website.

Seller

Means you, a third party who offer Goods for sale to us, the Company, through our online service.

Goods

Means the goods as specified in the Customer Receipt which you offer for sale to us through the Website;

Comparison Site

Means a third party website offering gadget trade-in quote comparisons and through which you are accessing these Terms and/or sending your information to us.

Customer Receipt

Means the information you provide to us about your Goods through the online downloadable form.

Services

Means collectively any online facilities, tools, services or information that we make available through the Website either now or in the future.

Buyback Quote

Means collectively any orders, invoices, dispatch notes, receipts or similar that may be in hard copy or electronic form;

Payment Information

Means any payment details required for the trade-in of Goods from the Website. This includes, but is not limited to, credit / debit card numbers, bank account numbers and sort codes;

Website

Means the site at www.lcdwaste.com to which you are sending your information through a Comparison Site and through which the Services will be provided to you;

Representation of Condition

Means the condition grade of the goods established after testing processes have been completed.

1. Services and Trade-In process

a) By using the Website and the Services, you ("you" or the "Seller") agree to all the provisions of these Terms and authorise us and our authorised agents, representatives and employees to purchase any Goods offered for sale by you as quoted on the Customer Receipt.

b) Please take great care when providing your Representation of Condition of your Goods as this is the information on which we rely to provide you with a fair Trade-In Quote. For the avoidance of doubt, the following standards must be met:

The damage to the goods much be declared in accordance to the specifications on the grading check.

The Goods must have no burn damage.

The Goods must be original and meet the manufacturer’s original specifications.

c) You are responsible for ensuring that all Goods are properly and securely packed. You are responsible for purchasing suitable insurance and/or tracking at a Post Office. We will not be responsible for items that do not reach us.

d) In order for the Buyback Quote to be valid, we must receive your Goods within fourteen (14) days from the date of submitting the Customer Receipt. If we receive the Goods later we will revalue them according to any changes made to the price list.

e) In accordance with the Customer Receipt, we will pay you an amount equal to the Buyback Quote that will be provided to you by us based upon Representation of Condition after we have completed testing process. Please allow us up to 3-5 business days, from when we inspect the Goods, until you receive your payment.

f) If, when inspected, your Goods do not meet the specification or condition explained in our grading check, the Company, at its sole discretion, shall have the full right to regrade the Goods or terminate Services. If we choose to regrade the Goods, we will do this using the then-current market value for the LCD(’s) in it's condition. Each case is considered individually, but any reduction in the Trade-In Quote may vary depending on how your item can be reused, resold or recycled. For the avoidance of doubt, if you would like to test your LCD’s before sending, please check according to the following criteria. The following table gives you an idea of the typical resulting reductions in the Trade-In Quote may be applied as set out below however please be aware that this is just a guide and every device is treated as a case by case scenario:

GOOD LCD

ONLY BROKEN GLASS. The inner LCD screen should have no marks, no pixels missing and no imperfections on the display. Backlighting should be working perfectly.

POOR LCD

The LCD has broken glass AND shows any of the following issues with the inner display:

-        Dead pixels

-        Marks or bruising

-        Red screens or yellow edges or any other signs of discolouration

-        Any signs of water damage

-        Backlighting issues

TOUCH/FLEX FAULT

The touch on the LCD is not working OR the flex/connector is damaged in any way. In other words, if the LCD cannot connect to a motherboard/tester device due to flex damage, and no display appears, this points to flex/connector damage. If the display is showing, but the touch is not responsive, or slower than usual, this points to a touch fault.

Please be aware that you should not send in your accessories to us with your device, any accessories received will be disposed of and it is not possible for these to be returned or replaced. If you do not go ahead with your trade-in and have the device returned, please note that we will be unable to return any accessories that have been sent to us. For clarification an accessory is anything other than the LCD itself, this includes the box.

When we have inspected your Goods we will then email you an amended Buyback Quote notifying you of any issues, the description difference and any resulting price difference. You will then have the option to accept or decline the amended Buyback Quote within 48 hours.

If you accept the amended Buyback Quote, we will process the Buyback as above. If you do not respond to an amended Buyback Quote within 48 hours then we will process the Buyback to initiate payment. At this point the transaction is complete and non-negotiable, and it is not possible to amend the Buyback Quote nor return Goods.

If the amended Buyback Quote is declined and you are not in agreement with the amended Buyback Quote you may have the Goods returned to you. You may be requested for return to cover postage and packing costs. If the return postage and packing fee per screen is not paid within 3 days of you rejecting the revised Buyback Quote we reserve the right to process the Goods and initiate payment for the Offered Value.

Please note that your recycler order must meet our buying criteria and any packages with non original LCD’s in will not be eligible for payment under our prices and will instead be regarded as scrap at £1 per KG.

2. Your Representations and Warranties

a) You represent and warrant to us that:

i) You are aged eighteen or above;

ii) You own the Goods you are sending to us for sale and have the right to sell them;

iii) The Goods are genuine as represented and are not counterfeit, stolen, adapted or in any way infringing of any other party's legal rights; and

iv) the description of the Goods is truthful, accurate and complete.

3. Title and Risk of Loss

a) Risk of loss in the Goods remains with you until the Goods are received by us, at which point risk of loss immediately transfers to us.

b) Title in the Goods remains with you until we have inspected the Goods and have initiated payment to you, at which point title immediately transfers to us.

4. Breach

a) We may in our sole discretion immediately terminate the Services, and/or refuse to provide future Services to you if:

) You breach these Terms or the terms of the Privacy Policy;

ii) We are unable to verify or authenticate any information provided by you;

iii) We believe that your actions may cause financial loss or legal liability to us; or

iv) We have reasonable grounds to suspect that you have engaged in fraudulent activity in connection with the Goods.

5. Indemnity

You will indemnify us against any losses arising out of your breach of these Terms, the law or the rights of any third party.

6. Disclaimer

Whilst we use our best endeavours to ensure that the Website is available, we are unable to guarantee uninterrupted availability. We may alter the content on the Website, the Services and these Terms and Conditions of Use at any time. The Company and our authorised agents, representatives and employees provide our services "as is" and without any warranty, condition or representation as to the Services, of any kind, express, implied or statutory. IN NO EVENT WILL THE COMPANY BE LIABLE TO YOU FOR ANY INCIDENTAL, CONSEQUENTIAL EXEMPLARY, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES arising out of these Terms. Our aggregate liability and the liability of our authorised agents, representatives and employees to you or any third parties in any circumstance is limited to the greater of (A) the estimated value of the applicable Goods as stated in the Buyback Quote or (B) GBP5.

7. General

a) These Terms apply to the Services and to all your activity on the Website.

b) These Terms will continue in full force until all the Services performed by the Company in relation to the Goods are complete.

c) These Terms may be terminated by the Company without notice for any reason or no reason, at any time.

d) These Terms will be governed in all respects by the laws of England and Wales.

e) All notices or requests pertaining to these Terms should made by email, if from you to us to enquiries@lcdwaste.com and if from us to you, to the email address provided by you to us in the Customer Receipt.

f) No failure by either party to require performance by the other party of any provision of these Terms will affect the full right to require such performance at any time thereafter;

g) No waiver by either party of a breach of any provision of these Terms will be taken or held to be a waiver of the provision itself.

h) In the event that any provision of these Terms will be unenforceable or invalid this will not affect the enforceability or validity of the Terms as a whole.

i) These Terms constitute the entire agreement between the parties with respect to the Services.
